1. Acceptance of Terms

By accessing and using BurnOnRead ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

BurnOnRead provides a platform for creating and sharing encrypted, self-destructing messages ("secrets"). The Service allows users to:

  • Create encrypted secrets with optional password protection
  • Share one-time view links that automatically delete after viewing
  • Set expiration times for secrets
  • Request secrets from others (Pro feature)
  • Access API for programmatic secret creation (Pro feature)

3. User Accounts

3.1 Account Creation: You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Accurate Information: You agree to provide accurate and complete information when creating an account.

3.3 Account Security: You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use.

4. Acceptable Use

You agree NOT to use the Service to:

  • Violate any local, state, national, or international law
  • Share illegal content, including but not limited to child exploitation material, terrorist content, or content that infringes intellectual property rights
  • Transmit malware, viruses, or any malicious code
  • Harass, abuse, or harm another person
  • Attempt to gain unauthorized access to the Service or related systems
  • Use the Service for spam or unsolicited commercial messages
  • Abuse rate limits or attempt to disrupt the Service

5. Content and Data

5.1 Your Content: You retain ownership of any content you transmit through the Service. However, you grant us the right to store, encrypt, and transmit your content as necessary to provide the Service.

5.2 Content Deletion: Secrets are automatically and permanently deleted after viewing (burn-on-read) or upon expiration. We cannot recover deleted content.

5.3 No Guarantee of Confidentiality: While we use encryption to protect your data, we cannot guarantee absolute security. Do not use the Service for highly sensitive information where compromise could result in significant harm.

5.4 Content Monitoring: We do not routinely monitor user content. However, we reserve the right to investigate reports of abuse and may access encrypted content if required by law.

6. Pro License and Payment

6.1 Paid Pro License: Certain features require a paid Pro license. The Pro license is a one-time payment providing lifetime access to Pro features.

6.2 Payment Processing: Payments are processed by Stripe. By purchasing a Pro license, you agree to Stripe's terms of service.

6.3 Lifetime Access: Pro licenses grant lifetime access to Pro features. There are no recurring charges or subscription fees.

6.4 Refunds: License fees are non-refundable except as required by law or at our sole discretion within 30 days of purchase.

6.5 Price Changes: We reserve the right to change Pro license pricing for new purchases. Existing license holders are not affected by price changes.

7. Termination

7.1 By You: You may terminate your account at any time by contacting us.

7.2 By Us: We reserve the right to suspend or terminate your account if you violate these Terms of Service or engage in fraudulent, abusive, or illegal activity.

7.3 Effect of Termination: Upon termination, your right to use the Service will immediately cease. Any secrets you have created may be deleted.

8. Disclaimers and Limitation of Liability

8.1 "AS IS" Service: The Service is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8.2 No Guarantee of Availability: We do not guarantee that the Service will be uninterrupted, secure, or error-free.

8.3 Limitation of Liability: To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

8.4 Maximum Liability: Our total liability to you for all claims arising from your use of the Service shall not exceed the amount you have paid us in the past 12 months, or $100 USD, whichever is less.

9. Indemnification

You agree to indemnify and hold harmless BurnOnRead, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms of Service
  • Your violation of any rights of another person or entity
  • Content you submit through the Service

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes by posting a notice on the Service or sending an email. Your continued use of the Service after such modifications constitutes your acceptance of the updated terms.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions.
